What is Collaborative Law Divorce?

Collaborative Law is a revolutionary new approach to divorce dispute resolution. Collaborative Law is generally a more affordable process than traditional litigation. 

 

In a Collaborative Law divorce case, clients from the outset agree to negotiate outside of the courthouse, fully disclose all information, act in good faith, and work as a team to reach the best possible agreement for all people involved in the divorce. They sign a contract called a participation agreement that spells out the guidelines of the process. Unlike litigation, there will be no attacking public court motions filed by opposing counsel. Collaborative Law divorce attorneys are trained in mediation and Collaborative Law and structure meetings to encourage productive discussions and reach mutually beneficial and acceptable agreements. 

 

Collaborative Law recognizes the complexity of divorce and allows parties to bring in other professionals, which provides a unique interdisciplinary approach that assists parties in planning for their futures. Divorce and separation affect all areas of people’s lives from their finances to their children and not just their legal commitment to each other. Professionals who are generally available to participate in the process, include, but are not limited to Divorce Coaches, Financial Specialists, and Child Specialists. If the clients cannot reach an agreement and have to turn to litigation, their Collaborative Law divorce attorneys, will withdraw from the case. This protects the clients and creates a safe place for negotiations. The clients never have to worry that the opposing attorney will ever be able to cross examine him/her/them in a courtroom and anything said during negotiations will remain confidential.
